Data Protection Seminar September 2010.
Mr. Billy Hawkes, Data Protection Commissioner recently gave a Data Protection Seminar in Waterford Institute of Technology. There was a dedicated WIT staff session and an open session which had delegates from businesses and organisations in the region. The seminar addressed the obligations that an organisation has under the Data Protection Acts and gave examples of what to do and what not to do.
Some particular points to note relate to the stages of the Data Protection process:
1. Beginning (getting the data)
- Inform the individual and get their consent
- Specify the purpose
- Only gather what is required
2. Middle (when you have the data)
- Be able to justify your reasons to process it
- Keep the data accurate and up to date
- Respond to access requests within 40 days
- Disclose data to a third party only if compatible with the Data Protection Acts or if it is an allowable exception within those acts
3. End (disposing of the data)
- Have a retention policy
- Dispose of the data in a secure manner
